Trump Files Lawsuit in Michigan Ensuring Secretary of State Benson Keeps Him on 2024 Ballot

LANSING, Nov. 1, 2023 ~ Former President Donald Trump, current Republican presidential frontrunner, filed a lawsuit Monday in Michigan‘s Court of Claims that aims to prevent Secretary of State Jocelyn Benson from keeping him off the 2024 presidential election ballot.

Trump’s lawyers argue that Benson, a Democrat, does not have the authority to keep him off the state’s ballot, despite her previously stating that she will not keep Trump off it unless the court rules otherwise. This case stems from a lawsuit filed against Benson in September by Wayne County activist Robert Davis that argues Trump’s efforts to overturn the 2020 election prevent him from appearing on the ballot under the 14th Amendment of the U.S. Consitution.

The amendment states that anyone from taking office who “engaged in insurrection or rebellion” against the Constitution after previously taking an oath for it. Similar lawsuits have been filed in Colorado, Minnesota, and New Hampshire.
