Judge Imposes Gag Order on Former President Trump in Federal Election Subversion Case

WASHINGTON, Oct. 17, 2023 ~ The federal judge overseeing the 2020 election subversion case against former President Donald Trump imposed a narrow gag order on him Monday.

Through the order, Trump is prohibited from making statements targeting witnesses, court staff, and prosecutors partaking in the hearing. U.S. District Judge Tanya Chutkan states “His presidential candidacy does not give him carte blanche to vilify … public servants who are simply doing their job.” Overall, the First Amendment does not protect Trump’s targeting speech toward court personnel. 

The gag order placed on Donald Trump marks a milestone, acting as one of the first major restrictions placed on the former president during the federal case. As a result, Trump will be forced to change his “vocal” campaign approach in order to comply to Chutkan’s order.
