Governor Whitmer Reacts to Michigan Supreme Court Decision to Remove Emergency Powers

Friday, October 2, the Michigan Supreme Court released a ruling stating many of the mandates issued by Governor Gretchen Whitmer were not legal under the State of Michigan Constitution.

Two separate votes were taken. The first vote called out her violation of the Emergency Management Act of 1976 , stating that after 28 days, the governor needs the approval of the legislature, which she did not have according to the court. This vote passed in a 7-0 unanimous decision.

The other vote was regarding whether or not Governor Whitmer violated the Emergency Powers of the Governor Act of 1945. This allows the Governor to declare a state of emergency and issue mandates in order to protect the safety of Michiganders. This vote ended in a 4-3 split, on the grounds she violated the separation of powers clause, specifically article 3 section 2.
