Just one day after voters passed Proposal Two, the Mackinac Center for Public Policy filed a federal lawsuit against Michigan Secretary of State Jocelyn Benson and Attorney General Dana Nessel, arguing the measure violates First Amendment free-speech protections.
DETROIT ~ A legal battle is already underway over Michigan’s newly approved Proposal 2, with the Mackinac Center for Public Policy filing a federal lawsuit one day after voters passed the measure. The challenge argues the “money out of politics” proposal violates First Amendment protections by restricting campaign contributions from certain organizations and expanding political disclosure requirements.
Supporters say the measure is intended to increase transparency and limit the influence of money in state politics, while opponents contend its language is overly broad and could affect nonprofit groups, independent journalists and other organizations that discuss candidates or ballot issues. The lawsuit is expected to be one of the first tests of the proposal as it moves toward implementation.
